Entry 8 ! 5th Amendment


Trials and Punishment

In Amendment 5 - Trial and Punishment, Compensation for Takings. Ratified 12/15/1791. it states :No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due processof law; nor shall private property be taken for public use, without just compensation.
This is saying that no one in court that is being sued or held against a crime shall talk or speak upon a judge without a lawyer or a representative. Nor shall someone be held up for the same crime twice. The constitution is involved because it is allowing the client to plead the fifth against the case.
I feel that this is an accurate statement because it gives people the rights to speak accordingly. People wont be in court all the time for the same crime because witnesses want to speak up at different times.
